Petitioner appeals the order of the Circuit Court of Putnam County that found that petitionerās claims under the West Virginia Consumer Protection Act are preempted by the Higher Education Act and the Federal Family Education Loan Program. In her complaint petitioner alleged that Respondent Pennsylvania Higher Education Assistance Agency, violated the West Virginia Consumer Protection Act by improperly contacting her in an attempt to collect a student loan that petitioner claims is invalid due to the Department of Educationās discharge of the loan.
