The petitioners seek a writ of prohibit to prohibition the circuit court from denying their motion to dismiss the underlying negligence action. The petitioners argue that the circuit court erroneously found (1) that respondent Blankenship’s relationship with his co-worker satisfied the “closely related” requirement for a claim of negligent infliction of emotional distress; and (2) that respondent Blankenship is entitled to proceed on his negligence claim for emotional injuries where a claim for negligent infliction of emotional distress would not otherwise survive. The petitioners ask this Court to direct the circuit court to dismiss all claims against them.
