The Week of October 14

This week the Supreme Court will hear arguments on Tuesday, October 15 and Wednesday, October 16. On Tuesday we are keeping an eye on State ex rel. Maxxim Shared Services v. Swope, a case involving the elements necessary to prove a claim of negligent infliction of emotional distress. We are watching two cases on Wednesday's docket.  The first case is State ex rel. Ladanye v. West Virginia Legislative Claims Commission, in which will the Court must decide if the Commission is bound by the Rules of Evidence and if its findings are subject to judicial review. In the second case, Christine Blanda v. Martin & Seibert, the Court is asked whether a violation of W.Va. Code ยง61-3-24 support a Harless claim.  We will keep you up to date!
