Patrick Graham, Executor, et al. v. Robert Asbury

The six living children of Helen Graham appeal the circuit court's order directing that the proceeds of Mrs. Graham's wrongful death lawsuit are to be shared with the estate of their deceased sister, Betty Asbury. Mrs. Asbury outlived their mother Mrs. Graham, but Mrs. Asbury died before the lawsuit concerning Mrs. Graham's wrongful death was resolved. The case concerns, inter alia, the meaning of "surviving child" in the statute that identifies the beneficiaries to a wrongful death suit, W.Va. Code § 55-7-6(b).
