Meredith v. Heartland of Clarksburg

Intentional understaffing of the Heartland Nursing Home in Clarksburg, West Virginia led to the unnecessary death of Toni Meredith, a relatively young woman who had entered the facility for rehabilitation, and died of severe neglect leading to gangrene.

Founder Jim Bordas tried the case with Chris Regan for two weeks and demonstrated to the jury that intentional wrongdoing caused the Meredith family to lose its beloved matriarch. A “high-low” agreement ended the trial after a $50 million compensatory award was rendered, but jurors indicated that they had contemplated an additional $100 million punitive award in the case as well.
